Asylum

Asylum in the United States is approved for citizens of foreign countries when they are able to establish that they run the threat of persecution if they return to their home country. In addition, the threat of persecution must be based on political opinion, religion, nationality, or membership in a particular social group.

Asylum in the United States may be granted to those who have just arrived in the country, or those who are already residing in the United States. If you are a new arrival or plan on coming to the United States, you may apply for asylum at the port of entry, be it airport, seaport, land border, or other points of entry.

If you are already in the United States, you must complete the application for asylum within one year of your arrival, whether you are in the country legally or whether you are undocumented. Asylum is a lengthy process and to be approved, you must provide solid and sufficient evidence, or show proof that you have been persecuted or are at risk of persecution if you return to your country of origin. The first step in getting the process started is obtaining and filing your application for asylum.
